Should I Sue?

Okay ladies I have a situation. You would think that all of my headaches would be gone with the wedding behind us, but no. I got married seven weeks ago and still no pictures. I received my DVDs two weeks ago. There were two cameras at the wedding, and the DVDs are enhanced with a menu. They did a lot of editing with music and other transition. So this was not something that could have been in a few days. Anyway, I'm having trouble with the photographer. The first time I called he said that he didn't understand what happened because he had sent them nearly two weeks through FedEx. He would find the tracking number and find the package. Meanwhile he asked for my e-mail address to send me a link of the pictures online. I never received a link, and another week passed before I talked to him again and that was only because I called him. So he said that he tracked the package and it was damaged so he ordered another set. While we were talking he told me that the pictures were being put in the books and would be sent out that day (this Monday), so they should be here on Tuesday or Wednesday. No Pictures yet! I'm sick of going back and forth with him. He has been paid in full. We are thinking of taking it to small claims court if we don't have them by the time we go home for Thanksgiving. Does anyone have any suggestions? Please help!!

Sorry to hear about all of the trouble you are going through with this jerk. I think you should take him to court. Save every email he sends you, try to tape each conversation, and get all of your documents such as contract, receipts, etc... Hopefully, it wont have to get this far and he gives you your items. I wish you much luck!

Being a vendor myself I know for a fact that stuff happens to packages in transit. I say send them a certified letter of intent and allow one week for your portraits to be delivered. If your demands are not met then take them to court. This way you give them ample time to make restitution and shows any court that you tried to solve the problem outside of the court system.

I agree with Niquey to give it another week. If you are willing, have him send it FedEx or UPS and just spring for it yourself (anything to get your stuff). Its terrible, because things do get messed up in the mail and I would hate for you to sue him if he has little control over it. Definitely give him time, or ask him what you should do. Have your contract and other agreements on paper ready just in case!

I agree w/sending a letter of intent then sue is A** off!!!! I went through this nightmare 1st time around. It was over 6 months b4 I finally got my photos still w/no albums. When I was going to sue, they changed their number and their shop location. And one of the only reasons I went w/them was to support a small black owned business. After that I refused to go to a small vendor again for something as important as a wedding. I know that's not fair but I refuse to take the chance again.

Wow Hamptons I'm really sorry that you have to go through this. Niquey is right, send a letter of intent, then if it isn't resolved that way, take him to the cleaners (I mean to court -- LOL!!!)
